CTSW prevailed in a motion to dismiss a $4 million action against a client, an investor in a shrimp business. The action included allegations of fraud and unjust enrichment based on the investor’s relationship to an estranged wife and a business partner running the business. The court agreed with CTSW’s argument that the fraud allegations, even if taken as true, did not sufficiently state a cause of action. In addition, the court further agreed that the relationship between the plaintiff and this investor client was too attenuated to sustain an unjust enrichment claim. The case was dismissed against the client without leave to replead. Steve Wagner represented this client.
