United States District Judge Katherine B. Forrest threw out a federal securities fraud case brought against our client, real estate developer Atit Javeri, by an investor, Delshah Group. The case is Delshah Group v. Atit Javeri, et al., 09 Civ. 6909 (KBF) (decided May 28, 2013). After a 4-week trial, Judge Forrest issued a 59-page Opinion and Order that dismissed all of the securities claims alleged against Mr. Javeri. The judge adopted each piece of evidence that our trial team, led by partner Sari Kolatch and assisted by senior counsel Leo Esses, submitted, and discredited the case plaintiff presented. In fact, the judge was so convinced by the case Sari and Leo advanced, that her closing remark was “plaintiff has failed to make out a claim pursuant to Sections 10(b) and 20(a) of the Exchange Act with respect to any named defendant. Indeed, it was not even a close call.”
