On March 29, 2011, Judge Deborah Batts of the Southern District of New York granted CTSW’s summary judgment made on behalf of our client, Aviation Services International, LLC (ASI), a subsidiary of Israel Aerospace Industries Ltd. (IAI) in JODA LLC v. Aviation Services International, LLC.  Plaintiff, a company that provided asset based financing to airlines, alleged that ASI failed to notify JODA of the termination of an aircraft services agreement with a non-party, as allegedly contractually required, causing it millions of dollars in damages.   ASI moved for summary judgment on several grounds, including that Plaintiff failed to establish that it sustained any damages as a result of the alleged breach.  Judge Batts granted ASI’s motion for summary judgment and dismissed the case in its entirety, adopting in whole all of CTSW’s arguments.

The CTSW team consisted of litigation partners Stephen Wagner and Sari Kolatch.
