CTSW’s litigation team successfully defended former Vertex/Motorola sales representative, Thomas Wineland, in an action alleging bid-rigging, antitrust and RICO claims, as well as state tort claim, brought by Gatt Communications Inc. (“Gatt”). Gatt alleged that Wineland and other co-conspirators engaged in a scheme against various New York State and City government agencies with respect to the purchase of a particular brand of mobile devices.  Gatt sought to recover damages from the termination of its contract to distribute those devices.  After losing at the trial court level, Gatt appealed.  On February 14, 2013, the United States Court of Appeals for the Second Circuit unanimously affirmed the prior dismissal on both procedural and substantive grounds.  Barring any further appeal, CTSW’s client secured a complete victory in this complex lawsuit.
