LITIGATION AS A TOOL, NOT AN END

Because we also counsel corporate and banking clients in large, complex, transactional matters outside of the bankruptcy arena, we have a broader perspective.  We recognize bankruptcy for what it is -- a means for our clients to achieve a particular result.  Likewise, we view litigation in the bankruptcy arena as but one of many options available to our clients.  When the decision is made to go to court, however, we do so aggressively, and with clear goals in mind.  We have successfully recovered distributions for creditor groups that would not have otherwise been offered to them absent our litigation strategies.  Yet, we litigate selectively only on those issues that advance our clients' strategic objectives.

In re Ziff-Davis Media Inc. (conflicts counsel for Official Committee of Unsecured Creditors)
In re Levitz Home Furnishings, Inc. et al. (represented a successful bidder at bankruptcy auction of all assets; and continuing to represent liquidator of approximately 35 locations)
In re Huffman Koos Inc./Breuner's Home Furnishings, Inc. (represented a liquidator in furniture liquidation sales (largest ever to date) for the benefit of creditors, resulting in substantial dividend to creditors)
In re Refco, et al. (represented certain hedge fund sellers of claims, resulting in significant recovery on account of unsecured debt)
In re Agway, Inc. et al. (represented an institutional purchaser of substantial accounts receivable portfolio
In re Today's Man, Inc. (represented bidder for substantially all assets of Debtor)
In re Actrade Financial Technologies, Ltd. (represented Official Committee of Equity Holders)
