BY YOUR SIDE, EVERY STEP OF THE WAY
CTSW litigators have represented the full range of clients, from individuals to multinational corporations, at every stage of the litigation process. We have appeared in state and federal courts across the country, including the U.S. Supreme Court.
We have experience in all aspects of business litigation, from pre-filing investigations, injunctions, attachments, restraining orders and other forms of preliminary relief, to motion practice, discovery, trials, appeals, arbitration, mediation, negotiation and settlement.
CTSW attorneys defend and prosecute complex commercial cases covering a broad range of business transactions and contractual relationships including:
-
international business disputes
-
-
fraud and breach of fiduciary duties
-
insurance coverage disputes
-
disputes concerning ownership of goods and other rights under the Uniform Commercial Code
-
licensing agreements and joint venture disputes
-
misappropriation of trade secrets
-
patent and trademark infringement
-
toxic tort and product liability actions
-
bankruptcy adversary proceedings and disputed matters
AGGRESSIVE EFFICIENCY
Zealous representation to us means aggressively pursuing litigation while at the same time continuously and objectively evaluating the strengths and weaknesses of our client’s case. These hard looks prevent litigation from spiraling out of control and enable us to identify, and where appropriate, recommend, the best possible juncture for settlement. Our goal is to look for win-win solutions so that productive business relationships are not needlessly scuttled because intractable posturing and non-business considerations were allowed to prevail.
PICASSOS, PHARMACEUTICALS AND EVERYTHING IN BETWEEN
Over the years, CTSW attorneys have represented entrepreneurs, as well as major multinational and Fortune 100 companies. The breadth of our practice is illustrated by the cases recently on our docket:
-
insurance proceeds for a stolen Picasso
-
consignments on aircraft engines
-
misappropriation of trade secrets for processing a broad-spectrum antibiotic drug
-
breach of code share agreement among airlines
-
insurance proceeds from business interruption and property damage resulting from September 11th
-
commercial real estate disputes
-
torts by a multinational shipping concern
-
theft of an international computer parts business
-
insurance proceeds for complex environmental claims
KNOWING HOW AND WHEN TO SETTLE
Let’s cut through the bravado – like all good litigators, CTSW is prepared and ready to take every case to trial; we know how to play hard ball and do. “Tit-for-tat” and “damn the torpedoes” may be appropriate in some instances. Such approaches, however, are not always in the client’s best interests and may serve only to run up costs since, in the end, the majority of commercial disputes settle. First and foremost, it is our clients’ business goals that guide all of our representations.
To achieve this end, CTSW lawyers use the same advocacy skills they honed in the courtroom in all forms of alternative dispute resolution. We frequently appear before mediators and arbitrators, including AAA and JAMS/Endispute. CTSW litigators also have been involved in settlements of multi-million dollar commercial disputes as well as the largest product liability cases involving pharmaceuticals and toxic substances.
